- If you continue to browse and use this website, you agree to comply with and be bound by the following terms and conditions of use.
- You are wholly responsible for use of the site by any person using your computer and you must ensure that any such person complies with these Terms.
- The reference to Peska (including “we”, “us” or “our”) includes those companies and all relevant group affiliates.
- The term ‘[N.BRIGHT NETWORK LTD] ‘us’ or ‘we’ refers to the owner of the website whose registered office is [302-540 LAWRENCE AVENUE,
KELOWNA BC V1Y 2A7, CANADA]. Our company registration number is BC1341662. - References to “you” in this notice are to the individual who is accessing or applying to use the Services (as defined below) either on your own account or on behalf of a business.
- This includes, in relation to a customer or prospective customer of Peska, any sole trader and any principals, including the managing and financial directors, any other directors and officers, shareholders, partners and beneficial owners of a customer, as well as any member of staff accessing or using the Services on behalf of a customer.
Registration for an account
- You must be at least 18 years of age.
- You must not be a resident of any country where we do not provide the Peska Service.
- You may open a Peska Account provided it is legal to do so in your country of residence.
- You must create an account by registering your details according to the instructions found on the Sign-Up page on our site.
- As part of the Sign-up process, you must agree to these Terms of Use and our Privacy Policy.
- You must represent and warrant that you will maintain the accuracy of such information and promptly update such registration information, as necessary.
- If you do not provide such information or fail to cooperate with us, we reserve the right to suspend or close your account.
- You must satisfactorily pass all of our required identity and security validation and verification checks.
Eligibility of Using Peska account
- User is required to provide Peska with his/her correct and latest information, to open and maintain an account.
- You must not make an upload from, or a withdrawal to, a payment instrument or bank account if you are not the named account holder.
We take any violation of this requirement very seriously and will treat such actions as fraudulent acts. - We reserve the right to decline any transaction at our sole discretion in circumstances where that transaction is fraudulent, would be in breach of these Terms of Use or any applicable law and regulation or you have insufficient funds to make the transaction.
- If you receive funds into your account that were not intended to be transferred to you, we will be entitled to remove these funds from your account.
- You must ensure that the payment details you enter when making a withdrawal and Transfer (Peer-to-peer) are correct and complete. We will not be liable for withdrawn funds being sent to the wrong account where this is due to your incorrect payment details.
Account security
- You need to immediately change your password and contact us without undue delay if you have any proof or suspicion that your Peska Account or any of the security features related to it have been compromised, stolen, lost or misappropriated.
- You must always take all reasonable steps to keep your Peska Account password and any other security features safe and never disclose them to anyone.
Our personnel will never ask you to provide your password to us or to a third party. - We follow a strict set of rules set by the FCAC in Canada.
Fees
- We will charge you the fees set out on our website for each transaction. You authorise us to debit from your account any applicable fees at the time of a transaction.
- We do not charge for registration and there is no monthly fee.
- We may change to set all fees without notification.
Paying-in Service
The contents of the Paying-in Service are as follows:
- When the user intends to collect its receivables from the customer, which have arisen out of the transactions, through the Paying-in Service,it shall notify the customer, in a manner convenient for it, of the Dedicated Account to which the customer shall make the payment for the said money.
In the said notice, the user shall explicitly inform the customer that the Dedicated Account is the account held by us as its payment-collection agency. - No upper limit shall be set for the amount to be paid into the Dedicated Account through the Paying-in Service,however we may set upper limit depending on all situation.
- We shall make the Forward Payment to the user on each Agreed Payment Date for the amount determined under items (1) and (2), paragraph 1 of Article 5.
(However, the amount may be determined separately if agreed between the Parties.) The said payment shall be made by bank transfer into the account designated by the user,or another manner agreed between the Parties. The user shall bear all costs for the Forward Payment.
Withdrawal funds
- You must log into your Peska account in order to make a withdrawal transaction.
- The transaction will be completed after Peska authorizer has confirmed it.
- The User shall make sure the registered banks operate US Dollar, Japanese Yen, British Pound, or Euro account corresponding to the withdrawal currency.
- For the case of requesting a cancellation of withdrawal to a Japanese local bank (in JPY), once we have confirmed the withdrawal transaction, Peska will charge a cancellation fee ¥3,300 plus bank charge ¥880.
- For the case of requesting a cancellation of withdrawal to the countries other than Japan, the cancellation fee and handling process is subject to change and may vary by locations. Please contact us for inquiries.
- Unwinding of funds transfer from a bank is not guaranteed. Rejection from bank may occur and any possible charges induced from the bank will be claimed from the user’s Peska account.
Foreign exchange service
- We provides the user four available currencies, US Dollar, Japanese Yen, British Pound, and Euro.
- We will suspend providing foreign exchange service when exchange market fluctuates dramatically.
- If we find and detect a suspicious trading, the transaction will be banned and cancelled temporally.
- When the exchange rate system got broken down, we shall suspend and cancel a foreign exchange transaction service immediately even though the user is about to complete the transaction.
Transfer (Peer-to-peer) service
- Transfer (Peer-to-peer) service shall be provided Peska users only, not to unregistered person.
- We shall monitor and control all transaction histories in its system.
- If we find and detect a suspicious trading, the transaction will be banned and cancelled temporally.
- We shall not be responsible regarding any trouble of Transfer (Peer-to-peer) transaction between the users.
- We shall not open individual information such as email address to other users to protect a privacy.
Material Breaches
The user shall not conduct any of the following actions:
- To notify, itself or by using a third party, the customer or any other persons of the Dedicated Account as the bank account to collect receivables held by any person other than the user.
- To notify, itself or by using a third party, the customer or any other persons of the Dedicated Account as the bank account to collect its receivables which have arisen out of a transaction other than the transactions.
- To have any person other than the customer to know the information about the Dedicated Account by giving notice or disclosure of or using another method to inform the same to unspecified third parties.
- To use the Dedicated Account for money laundering or another criminal activity or in such way as to result in the same, whatever method is used.
- To engage in any activity, itself or by using a third party, that violates one of the laws and regulations of United Kingdom, Japan, and other countries in its business operation(including, but not limited to, an activity without obtaining licences and approvals required by laws and regulations or going through legal procedures,fraudulent practice or blackmail against a third party, and other similar acts).
- To declare a false fact to us intentionally.
Closing Peska account
- If your account holds a balance at the time of unsubscription, we will ask you to withdraw your funds afterwards. If there is a balance, it will be transferred to your designated bank account after deducting the fee. If the fee cannot be deducted due to insufficient balance, the balance will be debited in full.
- All funds will be converted to the same currency based on the remittance destination and they will be transferred together.
- After the full balance is transferred to your designated bank account, the unsubscription procedure will be completed.
- Please note that you will not be able to log in to your account once the unsubscription request has been made.
- Peska will have the right to conduct any necessary investigation of money laundering, terrorism financing, fraud or other illegal activity before authorising any withdrawal of your funds, including in relation to your fund return after you have closed your account.
